First, Shizencos would like to introduce to you the process of carrying out Cosmetic Product Announcement for those of you who want to make cosmetics with your own brand, you can submit your own declaration documents to the Management Authority. cosmetics or contract with a professional cosmetics processing company and supervise every step of the process they will do for you.
Whether you are completing the Announcement procedure for just one product or several thousand different cosmetic items, you must go through the following 5 basic steps:
Step 1: Prepare the cosmetic declaration dossier
– For imported cosmetics:
Business registration / Registration to establish a Representative Office in Vietnam of the Enterprise that wants to have its name on the declaration (Notarized copy)
Cosmetic product announcement sheet (According to the prescribed form)
Authorization letter from the Manufacturer (Authorization letter) (Original copy with consular legalization)
Certificate of free circulation (CFS) of the product (Original copy that has been consularly legalized)
List of product ingredients according to INCI international nomenclature (Soft copy)
Business digital signature to digitally sign online cosmetic publication records
Business account at VNSW National One-Stop Information Portal (to submit online cosmetic declaration documents)
– For domestically produced cosmetics:
Business registration of the Enterprise whose name is on the Declaration (Notarized copy)
Business registration of the Enterprise that produces the product (in case the Manufacturer and Product Owner are different)
Product processing contract (in case the Manufacturer and Product Owner are different)
Cosmetic product announcement form
GMP certificate for cosmetics from the product manufacturer.
List of product ingredients according to INCI international nomenclature.
Step 2: Submit cosmetic declaration documents to state agencies
Dossier for declaration of imported cosmetics: received by the Drug Administration of Vietnam – Ministry of Health through the VNSW National One-Stop Information Portal (at https://vnsw.gov.vn).
Dossier for declaring cosmetics manufactured in Vietnam: received by the local Department of Health where the manufacturing factory is located or where the Product Owner is headquartered. Submit directly at the one-stop department, or online through the province’s public service portal (if any), or send by mail.
Step 3: Pay the cosmetic publication fee
– After submitting the cosmetic declaration dossier to the correct receiving agency in Step 2, you need to monitor the receipt of the dossier by the state agency to pay the cosmetic dossier appraisal fee according to regulations.
To declare imported cosmetics, you need to pay the cosmetic declaration fee/fee as soon as you receive the dossier receipt from the Drug Administration of Vietnam. Your profile is then transferred to the Cosmetic Management Department of the Drug Administration of Vietnam for appraisal processing.
For dossiers announcing domestically produced cosmetics, the publication fee can be collected in advance or later depending on the locality. You need to clearly ask the One-Stop Department to receive the application immediately upon submission to avoid cases where the application is kept unprocessed.
The fee/fee for Issuing a number to receive the Cosmetic Proclamation Form is 500,000 VND/set of documents (applies to both imported cosmetics and domestically produced cosmetics).
Step 4: Wait for the expert to review and appraise the file
– When your cosmetic declaration dossier is transferred to the appraisal expert department, some contents will be considered as follows:
General legal documents (including Business Registration, Cosmetic CFS, Letter of Authorization (LOA), GMP – if any)
Technical profile of cosmetic product ingredients according to the instructions of the ASEAN Cosmetic Agreement (content of banned substances, restricted substances, ingredients suitable for cosmetic uses…)
Check for violations in the cosmetics field of the enterprise, if any (whether the enterprise is within the period of suspension of cosmetics business, administrative violations in the cosmetics field, etc.)
Step 5: Return the result of cosmetic announcement
*The processing time limit for Cosmetic Announcement Procedures is as follows:
a) Within 03 working days from the date of receiving the valid announcement dossier and the prescribed announcement fee, the Drug Administration of Vietnam (or Department of Health) is responsible for issuing the product announcement receipt number. cosmetics.
b) In case the announcement dossier does not meet the regulations, within 05 working days from the date of receipt of the dossier, the Drug Administration of Vietnam (or Department of Health) shall notify the organization in writing electronically. the announcer knows the unsatisfactory contents in order to amend and supplement the dossier.
– Additional records of the unit include:
A written explanation of the amendment or supplementation of the organization or individual in whose name the announcement is made; The cosmetic product announcement sheet and/or other documents are amended and supplemented;
– Within 05 working days from the date of receiving additional documents that meet regulations, the Drug Administration of Vietnam is responsible for issuing the receipt number of the Cosmetic Product Announcement Form.
– In case the amended or supplemented dossier does not meet the regulations, within 05 working days from the date of receiving the additional dossier, the Drug Administration of Vietnam shall notify in electronic writing that it does not agree to issue the next number. Receive a cosmetic product announcement slip for this product.
c) Within 03 months from the date of issuance of the written notification as prescribed in point b above, if the Drug Administration of Vietnam does not receive additional dossiers from the organization or individual whose name is announced, the dossier will announcement is no longer valid.
– In this case, if the organization or individual wants to continue publishing, they must submit a new application and pay a new fee/fee according to regulations.
– The term of the cosmetic product announcement slip is 5 years from the date of issue.
